Oil rose to a dime within $120.00 today before selling off and the dollar is becoming the PESO with the reading having hot $1.60 per EURO. Interestingly enough, the oil services stocks are <a href="http://www.247wallst.com/2008/04/more-bad-news-f.html">not performing well </a>in earnings season despite record prices. More importantly, today's stock market shows that the market is still in a state of flux, and it may have become a stock picker's market. Until this finally doesn't work, the trade is to buy when you feel worried and sell when you are feeling good. Below are today's <em>unofficial</em> market index closing levels:<br />

<a href="http://finance.aol.com/quotes/brinker-international-inc/eat/nys">Brinker International, Inc.</a> (NYSE: <a href="http://finance.aol.com/quotes/brinker-international-inc/eat/nys">EAT</a>) saw shares rise by after the company narrowly bear earnings expectations. The company is one of <a href="http://www.247wallst.com/2008/04/stocks-which-co.html">"stocks to double"</a> by the recession end, and cost cutting and capacity monitoring did more goodwill today than the earnings. Shares were up by almost 7% at $20.90 in the final minutes of the day.<br /><br />If you wanted one ray of brightness for single stock, it would be the <a href="http://finance.aol.com/quotes/intrepid-potash-inc/ipi/nys">Intrepid Potash Inc.</a> (NYSE: <a href="http://finance.aol.com/quotes/intrepid-potash-inc/ipi/nys">IPI</a>) IPO, which was already on fire after Jim Cramer gave his play book tout for the stock. With a 30,000,000 shares offering at $32.00, you can assume the over allotment was already taken. <p>Doesn't it seem like another day where it is impossible to make money? We have earnings season without any sense that anybody's numbers can be raised. We have an ennui that comes from months of pounding and indecision, and we have stocks that can't seem to go up to save their lives. </p>
<p>Take retail and restaurants. <p>Does anyone even know how vicious the bear market in these stocks is? Not all of these companies are brain-dead. </p>

Can't they be worth something? </p>
<p>Ever since the collapse of private equity these stocks have declined pretty relentlessly. They have worn people down like you wouldn't believe. </p>
<p>But what happens in a turn? Shouldn't we think about putting on a basket of these? Maybe that Mortons/Ruth's/Ruby group? </p>
<p>Their balance sheets are almost all really strong. The consumer can come back. The earnings stream is there. </p>
<p><a href="http://finance.aol.com/quotes/costco-wholesale-corporation/cost/nas">Costco</a> (NASDAQ: <a href="http://finance.aol.com/quotes/costco-wholesale-corporation/cost/nas">COST</a>) (<a href="http://find.thestreet.com/cgi-bin/texis/cramertake_free?site=tsc&amp;puc=aoljjc&amp;tkr=COST" target="blank">Cramer's Take</a>) isn't the only retailer in this country doing well, give or take <a href="http://finance.aol.com/quotes/guess-inc/ges/nys">Guess </a>(NYSE: <a href="http://finance.aol.com/quotes/guess-inc/ges/nys">GES</a>) (<a href="http://find.thestreet.com/cgi-bin/texis/cramertake_free?site=tsc&amp;puc=aoljjc&amp;tkr=GES" target="blank">Cramer's Take</a>) and <a href="http://finance.aol.com/quotes/j-crew-group-inc/jcg/nys">J. Crew</a> (NYSE: <a href="http://finance.aol.com/quotes/j-crew-group-inc/jcg/nys">JCG</a>) (<a href="http://find.thestreet.com/cgi-bin/texis/cramertake_free?site=tsc&amp;puc=aoljjc&amp;tkr=JCG" target="blank">Cramer's Take</a>), <a href="http://finance.aol.com/quotes/urban-outfitters-inc/urbn/nas">Urban Outfitters</a> (NASDAQ: <a href="http://finance.aol.com/quotes/urban-outfitters-inc/urbn/nas">URBN</a>) (<a href="http://find.thestreet.com/cgi-bin/texis/cramertake_free?site=tsc&amp;puc=aoljjc&amp;tkr=URBN" target="blank">Cramer's Take</a>) and <a href="http://finance.aol.com/quotes/tjx-companies-incorporated/tjx/nys">TJX</a> (NYSE: <a href="http://finance.aol.com/quotes/tjx-companies-incorporated/tjx/nys">TJX</a>) (<a href="http://find.thestreet.com/cgi-bin/texis/cramertake_free?site=tsc&amp;puc=aoljjc&amp;tkr=TJX" target="blank">Cramer's Take</a>). </p>
<p>But the group has been gaffed and gutted. Somehow I think that some of these can come back. I know it's not gonna happen now. Too many questions. But when? When things turn you won't be able to buy these anywhere near where they are. </p>
<p>Yet, in a world where gasoline seems like it is marching to $4/gallon, where <a href="http://finance.aol.com/quotes/mcdonald-s-corporation/mcd/nys">McDonald's</a> (NYSE: <a href="http://finance.aol.com/quotes/mcdonald-s-corporation/mcd/nys">MCD</a>) (<a href="http://find.thestreet.com/cgi-bin/texis/cramertake_free?site=tsc&amp;puc=aoljjc&amp;tkr=MCD" target="blank">Cramer's Take</a>), which I own for <hlink href="http://secure2.thestreet.com/cap/prm.do?OID=005103&amp;cm_cat=AA&amp;cm_ite=005103&amp;cm_ven=EMAIL">Action Alerts PLUS</hlink>, can be crushed in a heartbeat and when gold's going to $1,000, the conventional wisdom of just forgetting this group seems to be playing out perfectly. </p>
<p>Yet, one has to wonder how a solid chain with good financials and good balance sheet simply can't be a buy soon, especially when it is just six months from lapping some really bad numbers. </p>
<p>What really weighs against it besides the consumer? Too many stores and restaurants. Until we see some closings, some trimmings, some shuttings and some bankruptcies, as we saw in 1990, I guess the operative wisdom is "Forget about it." </p>

We certainly are owed one, at least in Nasdaq land. <br /><br />Plus, when you go out with people from the trading desks, you are overwhelmed by the negativity. <br /><br />Last night at a buy-side/sell-side dinner, a smart guy I know who loves the short side tried to make a case for some down-and-out airlines and retailers. He's a price guy, meaning that he believes everything has a price and that you have to start looking at a Lowe's (LOW) here or a Macy's (M) because if you start buying now, put some on, you will be getting a pretty decent risk-reward ratio. <br /><br />I thought people were going to throw things at him. He was immediately ridiculed as someone who didn't understand what's out there, the collapse of consumer spending as evidenced by Brinker's (NYSE: <a href="http://finance.aol.com/quotes/brinker-international-inc/eat/nys">EAT</a>) (<a target="blank" href="http://find.thestreet.com/cgi-bin/texis/cramertake_free?site=tsc&amp;puc=aoljjc&amp;tkr=EAT">Cramer's Take</a>) Chili's, AT&amp;T (NYSE: <a href="http://finance.aol.com/quotes/atandt-inc/t/nys">T</a>) (<a target="blank" href="http://find.thestreet.com/cgi-bin/texis/cramertake_free?site=tsc&amp;puc=aoljjc&amp;tkr=T">Cramer's Take</a>), Family Dollar (NYSE: <a href="http://finance.aol.com/quotes/family-dollar-stores-inc/fdo/nys">FDO</a>) (<a target="blank" href="http://find.thestreet.com/cgi-bin/texis/cramertake_free?site=tsc&amp;puc=aoljjc&amp;tkr=FDO">Cramer's Take</a>) and all of the other usual suspects Tuesday.<br /> <br /> The lone long persisted, pointing out that Chico's (NYSE: <a href="http://finance.aol.com/quotes/chico-s-f-a-s-inc/chs/nys">CHS</a>) (<a href="http://find.thestreet.com/cgi-bin/texis/cramertake_free?site=tsc&amp;puc=aoljjc&amp;tkr=CHS" target="blank">Cramer's Take</a>) and Talbots (NYSE: <a href="http://finance.aol.com/quotes/the-talbots-inc/tlb/nys">TLB</a>) (<a href="http://find.thestreet.com/cgi-bin/texis/cramertake_free?site=tsc&amp;puc=aoljjc&amp;tkr=TLB" target="blank">Cramer's Take</a>) have come down so much. (The latter has a suspiciously high dividend for a retailer and is clearly having a hard time.) He argued that there is some brand value. <br /> <br /> Everyone laughed. <br /> <br /> Now, I would tell you that every company he mentioned at this dinner probably will miss numbers. We know from the action in every company that has missed numbers that there are endless sellers, people who genuinely just discovered that they were on something gone awry. <br /> <br /> But the universal nature of the scoffing at him made me take notice. <br /> <br /> Now, if you had said anything, word one, positive about housing for the last 18 months you have been hounded, and the hounders would have been right. <br /> <br /> Retail has a huge housing component when it comes to spending. But the housing companies have horrible balance sheets. Do you really feel that Hovnanian (NYSE: <a href="http://finance.aol.com/quotes/hovnanian-enterprises-inc/hov/nys">HOV</a>) (<a href="http://find.thestreet.com/cgi-bin/texis/cramertake_free?site=tsc&amp;puc=aoljjc&amp;tkr=HOV" target="blank">Cramer's Take</a>) and Pulte (NYSE: <a href="http://finance.aol.com/quotes/pulte-homes-inc/phm/nys">PHM</a>) (<a href="http://find.thestreet.com/cgi-bin/texis/cramertake_free?site=tsc&amp;puc=aoljjc&amp;tkr=PHM" target="blank">Cramer's Take</a>) and D.R. <p><a href="http://finance.aol.com/quotes/darden-restaurants-inc/dri/nys?tabs=quotesandnews">Darden Restaurants</a> (NYSE: <a href="http://finance.aol.com/quotes/darden-restaurants-inc/dri/nys?tabs=quotesandnews">DRI</a>) operates more than 1,300 casual dining restaurants in the United States and Canada. Its Red Lobster (seafood), Olive Garden (Italian cuisine) and Bahama Breeze (Caribbean items) chains cater to families, with mid-priced menu items and suburban locations. A small group of Seasons 52 restaurants feature a casual grill and wine bar concept. <a href="http://finance.aol.com/quotes/brinker-international-inc/eat/nys?tabs=quotesandnews">Brinker International</a> (NYSE: <a href="http://finance.aol.com/quotes/brinker-international-inc/eat/nys?tabs=quotesandnews">EAT</a>) and <a href="http://finance.aol.com/quotes/chipotle-mexican-grill-inc/cmg/nys?tabs=quotesandnews">Chipotle Mexican Grill</a> (NYSE: <a href="http://finance.aol.com/quotes/chipotle-mexican-grill-inc/cmg/nys?tabs=quotesandnews">CMG</a>) are competitors.</p>
<p>The company pleased investors last month, when it reported fiscal Q1 EPS of 73 cents and revenues of $1.47 billion. Analysts had been expecting 70 cents and $1.45 billion. Management also guided FY08 revenues to about $6.25-6.31 billion, versus consensus of $6.08 billion. The company confirmed that it plans to buy back $125-175 million of its common stock in FY08. <br /></p><img vspace="4" hspace="4" border="1" align="right" src="http://www.blogsmithmedia.com/www.bloggingstocks.com/media/2007/10/dri10032007.gif" alt="" />The news popped the shares out of an early September "cup" into the late September "handle" of a Cup &amp; Handle formation. The price is now showing signs of completing the pattern with a bullish rise from the right-hand side of the "handle."
<p>Brokers recommend the stock with four "strong buys," six "buys," six "holds" and one "sell." The DRI P/E ratio (16.25), PEG ratio (1.36), Price to Sales ratio (1.08), Price to Cash Flow ratio (10.32), Price to Free Cash Flow ratio (27.63), EPS Growth rate (19.67%), Return on Assets (13.03%), Return on Investment (19.72%) and Return on Equity (31.81%) compare favorably with industry, sector and S&amp;P 500 averages. Institutions hold about 81% of the outstanding shares. The stock is one of those used to calculate the S&amp;P 500 Index. Over the past 52 weeks, it has traded between $38.11 and $47.60. A stop-loss of $37.80 looks good here.</p>

The restaurants offer breakfast, lunch and dinner menus, featuring home-style comfort foods. The associated retail stores offer a variety of decorative, gift and food items. Competitors include <a href="http://finance.aol.com/quotes/brinker-international-inc/eat/nys?tabs=quotesandnews">Brinker International</a> (NYSE: <a href="http://finance.aol.com/quotes/brinker-international-inc/eat/nys?tabs=quotesandnews">EAT</a>) and <a href="http://finance.aol.com/quotes/darden-restaurants-inc/dri/nys?tabs=quotesandnews">Darden Restaurants</a> (NYSE: <a href="http://finance.aol.com/quotes/darden-restaurants-inc/dri/nys?tabs=quotesandnews">DRI</a>).</p>
<p>The firm pleased investors earlier in the week, when it reported solid results for its fiscal fourth quarter and issued in-line<img vspace="4" hspace="4" border="1" align="right" alt="" src="http://www.blogsmithmedia.com/www.bloggingstocks.com/media/2007/09/cbrl09212007.gif" /> guidance for FY08. The board subsequently boosted the quarterly dividend by 29% and declared a one million share buyback program. The stock popped on the quarterly report and has since moved into a bullish "pennant" consolidation pattern. Prices frequently exit pennants moving in the same direction they were traveling when they entered them. In this case, that would be to the upside.</p>
<p>Brokers recommend the issue with two "strong buys", ten "holds" and one "sell". The CBRL P/E ratio (15.25), PEG ratio (1.27), Price to Sales ratio (0.42), Price to Cash Flow ratio (7.44), Price to Free Cash Flow ratio (7.15), EPS Growth rate (35.29%) and Return on Equity (37.39%) compare favorably with industry, sector and S&amp;P 500 averages. Institutions hold about 95% of the outstanding shares. The stock is one of those used to calculate the S&amp;P 400 MidCap Index. Over the past twelve months, it has traded between $35.75 and $50.74. A stop-loss of $35.75 looks good here.</p>

EMC will retain 90% of the shares. This is likely the reason for the active calls as <a href="http://finance.aol.com/quotes/emc-corporation-mass/emc/nys?tabs=quotesandnews">EMC Corp.</a> (NYSE: <a href="http://finance.aol.com/quotes/emc-corporation-mass/emc/nys?tabs=quotesandnews">EMC</a>) saw heavy volume on the August 19 calls (EMCHT) with over 56,000 options trading. </p>
<p><a href="http://finance.aol.com/quotes/centex-corporation/ctx/nys?tabs=quotesandnews">Centex Corporation</a> (NYSE: <a href="http://finance.aol.com/quotes/centex-corporation/ctx/nys?tabs=quotesandnews">CTX</a>) fell $2.78 (-7%) to $35.63. <a href="http://finance.aol.com/quotes/lennar-corporation/len/nys?tabs=quotesandnews">Lennar Corporation</a> (NYSE: <a href="http://finance.aol.com/quotes/lennar-corporation/len/nys?tabs=quotesandnews">LEN</a>) fell $2.53 (-7%) to $32.92. <a href="http://finance.aol.com/quotes/brinker-international-inc/eat/nys?tabs=quotesandnews">Brinker International</a> (NYSE: <a href="http://finance.aol.com/quotes/brinker-international-inc/eat/nys?tabs=quotesandnews">EAT</a>) rose $1.82 (7%) to $28.98. <p>In options there were 5.4 million puts and 5.8 million calls traded for a put/call open interest ratio of 0.92. The <a href="http://finance.yahoo.com/q?s=%5Evix">CBOE Volatility Index</a> has been high closing today at 26.57. This is the fear indicator of the market. Not only is the index up, but options on the index are high with the <a href="http://finance.yahoo.com/q?s=%5Evix">CBOE S&amp;P 500 Volatility Index</a> (NASDAQ: <a href="http://finance.yahoo.com/q?s=%5Evix">$VIX</a>) moving volume on the August 25 calls (VIXHE) with over 35,000 contracts. </p>
